Seller Liability Notice

All legal, regulatory, food-safety, hygiene, taxation and quality risks associated with selling food, perishables or any product on Foodambo lie entirely with the Seller. Sellers must hold a valid FSSAI license (or registration as applicable) before selling food. Selling without a valid FSSAI certificate, or in violation of any applicable law, is the Seller's sole responsibility and liability. Foodambo is only a technology platform that connects buyers and sellers.

Welcome to Foodambo ("we", "us", "our", "Platform"). By creating an account, listing products, placing orders, or otherwise using foodambo.com or its mobile interface, you ("User", "Seller", "Buyer") agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.

1. Nature of the Platform

Foodambo is a hyperlocal marketplace that connects independent home chefs, home-based sellers, and small artisans with buyers within a limited geographical radius. Foodambo is not a manufacturer, producer, packer, importer, distributor, restaurant or food business operator. Foodambo does not prepare, cook, store, package, label, transport, or deliver any food or product listed on the Platform.

Every transaction is a direct contract between the Buyer and the Seller. Payments are made directly from the Buyer to the Seller via UPI; Foodambo does not hold or escrow funds for orders.

2. Seller Obligations & Compliance

By creating a Seller account, you represent and warrant that:

  • You hold a valid FSSAI License or Registration(whichever is applicable to your scale of operations) before listing any food item, OR you will obtain it within the 15-day grace period offered by the Platform. Operating beyond the grace period without a valid FSSAI document is a breach of these Terms and applicable law.
  • You comply with the Food Safety and Standards Act, 2006 and all rules, regulations, notifications and amendments thereunder, including but not limited to hygiene, labeling, packaging, weights & measures, allergen disclosure, and storage temperature requirements.
  • You are solely responsible for the safety, freshness, quality, quantity, ingredients, allergens, expiry, packaging, hygiene, and accurate description of every product you list or sell.
  • You comply with all applicable laws including GST, income-tax, consumer-protection laws, local municipal regulations, and obtain any additional permits required for your business.
  • You hold and maintain proper insurance where required, and you indemnify Foodambo against all claims arising from your operations.
  • Information you provide (name, address, FSSAI number, phone, photographs, pricing) is accurate, current and not misleading.

3. Risk and Liability — IMPORTANT

All risk associated with a sale lies with the Seller. This expressly includes (without limitation):

  • Foodborne illness, food poisoning, allergic reactions, contamination, spoilage or any health-related claim
  • Operating without a valid FSSAI license, or with an expired/suspended/cancelled license
  • Misrepresentation of ingredients, veg/non-veg status, dietary claims (e.g., "organic", "sugar-free", "homemade")
  • Tax compliance, invoicing, GST registration where applicable
  • Any civil, criminal, or regulatory penalty imposed by any authority including FSSAI, FDA, municipal, or police authorities
  • Disputes with buyers including refunds, replacements, missing items, late delivery, wrong delivery, or unsatisfactory experience

Foodambo expressly disclaims all liability arising directly or indirectly from any product or service offered by a Seller. The Buyer's recourse is solely against the Seller.

4. Buyer Responsibilities

  • You are solely responsible for verifying the Seller's FSSAI status, hygiene practices, and product details before placing an order.
  • If you have allergies, dietary restrictions, or medical conditions, confirm ingredients directly with the Seller via in-app chat before ordering.
  • Payment is made directly to the Seller via UPI; Foodambo cannot reverse, refund or claw back UPI transfers.
  • Reviews and ratings must be honest, lawful and not defamatory.

5. Founding Member Program

The first 1001 user accounts may receive free seller access for twelve (12) months from their date of registration ("Founding Member benefit"). Founding Member benefit is non-transferable, has no cash equivalent, and may be revoked by Foodambo for fraud, misuse, or breach of these Terms. After 12 months (or earlier termination), standard pricing applies.

6. Fees, Payments and Refunds

Foodambo may charge platform fees including (but not limited to) a one-time activation fee, a periodic subscription, or per-listing fees, as displayed on the Platform from time to time. Fees, once paid, are non-refundable except as required by law.

Order payments are settled directly between Buyer and Seller via UPI. Foodambo does not collect, hold, or settle order proceeds. Refund or replacement of an order is solely between the Buyer and the Seller.

7. Account Suspension & Termination

Foodambo may suspend or permanently disable any account, listing, or store with or without prior notice if it believes, in its sole discretion, that the User has breached these Terms, applicable law, or acted in a manner harmful to the community or platform. Examples include expired FSSAI license, repeated quality complaints, fraudulent listings, chargeback misuse, or harassment.

8. Donations

Donations made on Foodambo are voluntary contributions to support the Platform's operations and homemaker outreach. Donations are non-refundable, are not tax-deductible unless explicitly stated, and do not entitle the donor to any goods or services.

9. Intellectual Property

All Platform branding, software, design, copy and database structure are owned by Foodambo. Sellers retain ownership of their own listing photos and copy but grant Foodambo a worldwide, royalty-free license to display, reproduce, and promote them on the Platform and its marketing channels.

10. Limitation of Liability

To the maximum extent permitted by law, Foodambo's aggregate liability for any claim arising out of or related to the Platform shall not exceed the amount of platform fees paid by the User to Foodambo in the three (3) months immediately preceding the claim. Foodambo is not liable for indirect, incidental, consequential, special, exemplary or punitive damages, including loss of revenue, goodwill, or data.

11. Indemnity

You agree to indemnify, defend and hold harmless Foodambo, its founders, employees, agents and affiliates from and against any claim, demand, loss, damage, fine, penalty or expense (including reasonable legal fees) arising out of or related to (a) your use of the Platform; (b) any product or service you offer or buy on the Platform; (c) your breach of these Terms or applicable law; (d) any FSSAI, food-safety, taxation or consumer-protection violation by you.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to applicable consumer-protection laws, the courts at Pune, Maharashtra shall have exclusive jurisdiction over any dispute.
